- Article 1 : Object

The purpose of these “general terms and conditions of sale” (hereinafter: “GCS”) is to provide a legal guidance of the terms governing the provision of the Service available on the www.andromide.com website (hereinafter: “the Website”) and their use by “the Customer”.
The GCS must be accepted by all the Customers wishing to access the Service. The Customer declares having read these GCS and having accepted them by ticking the box provided for this purpose before paying online on the Website.
In case of non-acceptance of the GCS stipulated in this agreement, the Customer must renounce access to the Service offered by the Website.
www.andromide.com reserves the right to unilaterally modify the content of these GCS at any time.
- Article 2 : Definitions

The present clause is intended to define the various essential terms of the contract Agreement::
- Customer: this term refers to any person who uses the Service offered by the Website.
- Service: refers to all services provided by Andromide.com.
- Customer Content: refers to the data transmitted by the Customer within the Website.
- Personal Space: Allows the Customer to manage his bookings.
- Booking: means any journey booking made and validated by the Customer.
- Article 3 : Personal Data

The information requested during the process of registration to access the Service is necessary and mandatory.
The Customer guarantees that all the information given in the booking form is accurate. He undertakes to update this information in his Personal Space in the event of changes.
The Website ensures the Customer a collection and a treatment of personal information respecting privacy in accordance with the French law n°78-17 of January 6, 1978 relating to data processing, files and liberties.
The Website is registered with the CNIL (French Data Protection Authority) under the number 2008408v0.
Pursuant to articles 39 and 40 of the law of 6 January 1978, the Customer has the right to access, rectify, delete and oppose his personal data. The Customer exercises this right via :
- His Personal Space;
- The contact form;
- By email to contact(@)andromide.com;
- By postal service at 66 Avenue des Champs Elysées; Lot 41, 74008, Paris, France.
The Customer is responsible for keeping his password secret. Any disclosure of the password, whatever its form, is forbidden.
The Customer must immediately contact Andromide.Cab if he notices that his Account has been used without his knowledge. He acknowledges Andromide.Cab's right to take all appropriate measures in such a case.
- Article 4 : Access To The Service

- www.andromide.com is a Transport Service that provides pre-booked travel services in Transport Vehicles with driver (VTC). These transport services may include but are not limited to:
- Fares (journeys from point A to point B).
- Provision with hourly pricing.
The Website is accessible at any location to any Customer with Internet access. All costs incurred by the Customer to access the Service (hardware, software, Internet connection, etc.) meet the costs of the Customer.
The Website implements all the means at its disposal to ensure quality access to its services. Andromide.Cab cannot be held responsible for any event due to a case of force majeure resulting in a network or server malfunction.

- Article 5 : Booking

It is up to the Customer to select on the website www.andromide.com the Services he wishes to reserve, according to the following terms and conditions:
5.1 : Single Journey (From Point A To Point B):
The Customer enters his departure and arrival address, the day and time. A choice of vehicles and rates will be proposed. The Customer selects the desired range, he will be invited to log on to his Customer Space or to register. He fills in the booking form and chooses a payment method.
5.2 : Provision (On Hourly Basis):
The Customer fills in his departure address, the number of hours desired, the day and the time. A choice of vehicles and rates will be proposed. The Customer selects the desired range, he will be invited to connect to his Customer Space or to register. He fills in the booking form and chooses a payment method.
5.3 : Event (Wedding, Excursion, Etc.):
The Customer fills in the contact form on the page (contact) in order to request a personalised quote.
The Website reserves the right to cancel or refuse any booking from a Customer with whom there is a dispute concerning the payment of a previous booking.
The Customer may modify his booking on the Website in his/her Customer Space.
- Article 6 : Pricing

6.1 : Trajet Simple (De Point A À Point B):
The rate is communicated immediately by the online booking module during the booking.
The rate includes 60 minutes of free waiting time at the airport and 10 minutes of free waiting time for other trips outside the airport. Beyond that, the Customer will be charged 1€ per additional minute. He will be asked to pay this extra charge directly to the driver.
The rate does not include special requests, for example: one or more stops on the way, change of destination, additional waiting time, bulky luggage, etc. The Customer will be asked to pay this extra directly to the driver.
6.2 : Mise À Disposition (Réservation À L’heure):
The rate is communicated immediately by the online booking module during the booking.
The rate includes 25 km per hour reserved, for example: The Customer reserves a 5 hours availability, therefore 125 km will be included in his booking.
Beyond that, the Customer will be charged 1.5€ per additional kilometer. He will be asked to pay this supplement directly to the driver.
The Website reserves the right, at its own discretion and according to terms and conditions of which it will be the sole judge, to propose promotional offers or price reductions.
Promotional codes are valid for individuals only. They cannot be combined with other promotional codes. A promotional code cannot be exchanged for money.
- Article 7 : Terms Of Payment

The price shall be paid by secure payment, on the Website, according to the following terms and conditions:
- Payment by credit card.
- Payment by PayPal.
The full price is payable by the Customer on the day of the Booking.
Payment data is exchanged in encrypted mode via the protocol defined by the approved service provider intervening with the banking transactions carried out on the Website www.andromide.com.
The Website will not be obliged to provide the Services ordered by the Customer if the Customer does not pay the price in full under the conditions indicated above.
- Article 8 :Cancellation

Cancellation is free of charge according to the following terms and conditions:
- Single journey (from point A to point B): The Customer may cancel his booking free of charge up to two hours before the pick-up.
- Provision (on hourly basis): The Customer may cancel the booking free of charge up to 12 hours before the pick-up.
In case of failure to respect this deadline, the full amount initially provided for during the booking will be applicable.
- Article 9 :Responsibility

9.1 : Client:
The Customer undertakes to respect the laws and regulations in force (in particular the rules of the Highway Code, including seat belt wearing) and not to infringe the rights of third parties or public order.
It is forbidden to smoke, eat, drink alcohol and transport dangerous goods.
Damage of any kind caused to the vehicle and/or other vehicles (for example, when opening the doors unintentionally) will be charged to the Customer unless it can be proven that the damage was caused by a third party. The vehicle's occupants, employees, service providers and guests of the Customer cannot be considered as Third Parties.
The number of authorised passengers (including the driver) is the one indicated in the technical characteristics of the vehicle. It may never be exceeded.
The transport of animals is prohibited without a transport cage, unless prior authorisation has been duly mentioned on the Agreement, or in the case of animals accompanying visually impaired persons.
Failure to comply with these conditions will engage the exclusive responsibility of the Customer and the passengers both towards Andromide.Cab and third parties.
Andromide.Cab reserves the right to interrupt the service in progress if the driver notices that the Customer is committing an offence, for example the use of narcotics or alcohol, and also if the behaviour of the Customer jeopardizes the driver or vehicles safety.
9.2 : Andromide.cab:
Andromide.Cab is committed to transporting its passengers within the agreed time limits, under optimal safety conditions.
Andromide.Cab is liable for any damage caused intentionally or by gross negligence.
Andromide.Cab undertakes to provide the Service with diligence, it being specified that it has an obligation of means, to the exclusion of any obligation of result, which the Customers expressly acknowledge and accept.
If Andromide.Cab is unable to provide the vehicle specified in the agreement, Andromide.Cab undertakes to provide the Customer with a vehicle of equal or higher range without any increase in the price established during the booking.
If Andromide.Cab is unable to honour its commitment to the Customer, the company undertakes to inform the Customer as soon as possible, and to refund the full amount paid during the booking.
- Article 10 :Hypertext Links
Outgoing hypertext links to partner websites may be present on the Website, however the web pages where these links lead do not engage the responsibility of the Website which has no control over these pages.
- Article 11 :Duration
The duration of this agreement is indefinite. The agreement takes effect with respect to the Customer as of the use of the service.
- Article 12 :langue
The language of interpretation of these General Terms and Conditions is the French language in the event of a contradiction or dispute in another language as to the meaning of a term or provision.
- Article 13 :droit applicable et juridiction compétente
French law applies to this agreement, even if the service is provided in a foreign country. In the absence of an amicable resolution of a dispute between the parties, only the courts of Paris are competent.
